You must be at least 21 years of age to visit this site. By using this website, you represent your acceptance and acknowledgement of the provisions laid out below. We urge you not to use this website if, for any reason, you do not accept these terms and conditions in their entirety. 

Thebourboncentral.com (herinafter the “website” or “site”) is an online store owned and operated by Bourbon Central (hereinafter “Bourbon Central”). All prices listed on the site may change without notice. Bourbon Central is not liable for typographical errors and reserves the sole and absolute right to change incorrect pricing. Bourbon Central also is not liable for any variations between product images and the items that a customer receives -- including but not limited to the inclusion of a product box. Bourbon Central further reserves the right to revise these terms and conditions at any time, at its sole and absolute discretion. Your continued and ongoing use of the website following any such changes acknowledges your acceptance of those changes and any manner by which they apply to you. If you do not agree with these terms and conditions of use, we urge you not to use this website. In the event you breach any of these terms and conditions of use, and if you are not over the age of 21, your right to use this website shall automatically terminate. 

This Shipping Policy (“Shipping Policy”) shall be read in conjunction with the Terms of Service, Privacy Policy, and Return and Exchange Policy that can all be found at thebourboncentral.com

Shipping Policy

• In order to cover lost or breakage of a bottle in shipments, Bourbon Central Shipping Insurance must be purchased at the time of checkout.
• Any non-leakage damage and/or cosmetic defects to the bottle or its respective packaging are all possible to occur during transit. Bourbon Central or its shipping warranty does not take responsibility for these damages.
• Any order made including a custom engraving is subject to a 24-72 hour delay, with respect to fulfillment time. All custom engraved items are final sale, and will not be eligible for a return or refund in any format.
• Depending on availability, product boxes, accessories, and/or specific annual releases/acts of a product as pictured on our product pages may or may not be included in a package. Product boxes or labels may also vary from annual vintages/releases displayed on the images included herein.
• In the case that packages are lost due to hold requests or delivery rescheduling, Bourbon Central will not be held responsible.
• If a customer wishes to cancel his/her order, he/she must e-mail or call Bourbon Central regarding the change prior to when the package is dispatched to a carrier.
• In the event that a customer orders a product with a custom engraving and subsequently requests a cancellation, it will not be honored. All engravings must be paid for, by purchasing the $19.99, 'Custom Engraving' item, prior to shipment.
• In the event that a customer requests a shipping address redirect when his/her package is in transit, Bourbon Central's customer success team will correspond with an invoice for $20.50 to cover the fees it is billed by its carriers. If the invoice is never completed, no address change will be honored.
• If an undamaged package is returned to the merchant because of failed delivery attempts or any desire to return the items after the product has left the merchant's facilities, the customer will be responsible for a 30% restocking fee and return shipment fee, to cover the postage and restoration cost on the merchant end.
• If a customer is unable to receive their package after two (2) delivery attempts, Bourbon Central's shipping team will automatically redirect the package to the nearest Access Point, if their carrier allows. The customer thereafter is liable for retrieving the package from said access point. 
• Any return request for a successfully delivered product must be made within 72 hours of the time of delivery. Any request received after that time frame will not be honored in light of potentially tampered bottles. In the event of a return of any package, the original shipping cost and warranty shall be nonrefundable given that the merchant has already paid for such services.
• Upon delivery, an adult (21 years of age or older) must be available to sign for your package.
• The customer is solely responsible for the shipment of alcohol and must abide by their local and state laws. 
• All orders placed Monday through Friday will be shipped out within 1-5 business days. Exceptions may apply during peak season and/or if a product is on backorder.
• All Ground shipments placed Monday through Friday before 4 P.M. EST will be shipped out within 1-5 business days. Please be advised that if the item is not currently in stock, delivery may be delayed. Shipping times vary based on the state and its alcohol shipping laws. Delivery on weekends is directed at the sole discretion of the carrier. 
• All Express shipments placed Monday through Friday after 9 A.M. EST will be shipped out within 36 hours. Please be advised that if the item is not currently in stock, the shipment may be delayed. Delivery on weekends is directed at the sole discretion of the carrier. Bourbon Central bears sole liability for tendering a package to the designated carrier on this timeline, not the end delivery date. All subsequent developments in the delivery schedule are determined by the carrier and fall out of the domain of the merchant's control.
• If, for any number of reasons, an express package is not dispatched to a carrier in accordance with the aforementioned timeline, a customer will be entitled to a refund for the cost differential between the express charge they paid, and our typical ground shipping charge. 
• Orders placed on Friday after business hours, Saturday or Sunday — whether express or ground — will be shipped out within 1-5 business days from the following Monday.
• If, for any number of reasons, a customer receives the incorrect items, he/she must contact Bourbon Central via e-mail or phone for a remedy. The customer will be issued a prepaid return shipping label and MUST ship the incorrect items back to receive either a refund or a new shipment with the correct items. If the customer selectively chooses to keep the items, it will be assumed that he/she is satisfied with the purchase and doesn't require a remedy. 
• Bourbon Central guarantees that it will adhere to the aforementioned timelines. Any subsequent delay by a carrier due to conflicts on their behalf are not the liability of the merchant. 
• All shipping timelines are subject to the sole discretion of a carrier. The customer's selected shipping method will determine the when the package is delivered, and will override any personal guarantee made by merchant. 
• We do not ship internationally, at the moment. 

• Bourbon Central does not ship to P.O. boxes under any circumstances. If a P.O. Box Address is entered at checkout, the merchant will automatically direct the package to the customer's billing address, if applicable.

• Purchase of Alcoholic Beverages: By placing your order, you have represented to Bourbon Central you are giving full, undisputed consent to Bourbon Central to charge your credit card for the total amount of your order. 

• You represent to Bourbon Central that all items purchased on the website are for personal consumption and not for resale. You will be charged sales tax, if any, as may be assessed by your State for the sale of alcoholic beverages. On all products, you’ll be responsible for local taxes imposed by your State, if any. 
• Once an order is placed, any address change request must be made promptly. Bourbon Central will make a good faith effort to accommodate such requests, but makes no guarantee such address changes can be accomplished. All fees and charges associated with an address change will be passed to the customer. 

• Title to Goods: Laws concerning the sale and shipment of alcoholic beverages are complex, constantly changing, and different from State to State. Accordingly, you will be the legal owner of the goods when your payment has been processed and received, and all or any holds have been cleared. Accordingly, the title to all alcoholic beverages purchased on this Site passes to you when the goods are picked up by the common carrier. 

• Shipping Laws: You are responsible for abiding by all State and local laws, rules, and regulations of your State pertaining to ordering and receiving alcoholic beverages from out of state. You additionally represent you have received any required permission, paid any required fees, are in cooperation with properly licensed intermediaries where required, and are legally entitled to take possession of the alcoholic beverages. You further represent you are legally entitled to take possession of the quantities ordered, and that you and the person accepting delivery of the alcoholic beverages are at least 21 years of age. 

• By making a purchase on our site, you are asking us to appoint a common carrier and arrange for the transportation on your behalf for the delivery of alcoholic beverages and any other purchased merchandise to you. By making use of this service from Bourbon Central, you are acting in agreement with your local and State laws regarding the purchase, transportation, and delivery of alcoholic beverages. Accordingly, we make no representations or warranties concerning the legal requirements of shipping alcoholic beverages to your State; our website merely provides a list of those States where common carriers have indicated their willingness to deliver alcohol. As such, you understand and acknowledge you are accountable and liable for compliance with all laws concerning such shipments to your State, and you further agree to indemnify and hold harmless Bourbon Central, its agents, officers, shareholders, directors, and employees, from any and all claims, demands, damages, liability, whatsoever, whether in tort, contract, or otherwise, arising out of the shipment of alcoholic beverages to your State, including any and all claims that such shipments may violate any federal, state, or local regulation pertaining to the sale and shipment of alcoholic beverages. 

• Change in Shipping Laws: Following the placement of any order, and prior to the goods being shipped, in the event the laws of your State change so as to make it illegal for you to import alcoholic beverages into your State, you may return the order for a full refund, provided however, you have submitted proof to Bourbon Central, and its counsel, or regulations pertaining to such law changes. Once an order has shipped, title to the goods has passed to you in accordance with the terms and conditions stated herein and no refund can be issued. 

• Shipment Method, Timing, and Delivery: While Bourbon Central makes every effort to fulfill orders at a reasonable speed, a typical order can take an average of 1-5 business days to ship. Please allow at least 8-10 business days for delivery. Shipping charges are calculated based on weight, destination, and delivery method

• All products must be received and signed by an adult over the age of 21. Deliveries will not be left at any address or with any individual without such a signature. You are responsible for checking your order immediately after delivery. Items must be reported as missing or incorrect within 48 hours of receiving the delivery. 
• In the event that an incorrect item was shipped, you must submit a photo of the sealed box along with your receipt or order number in an email to Bourbon Central. If you are not contacted by us within 14 days of your email for any reason, please send another email from a different email address if possible. 

• Failed Delivery Attempts: If you fail to receive your order after the allocated number of attempts of delivery under the shipping agency’s policies, and the product is sent back to Bourbon Central, a thirty percent (30%) restocking fee will be deducted from your refund. Shipping costs will not be refunded. If the item in question was initially shipped free of charge due to an ongoing promotion, we will deduct thirty-five dollars ($35) from the refund for shipping and handling. If the package is returned to Bourbon Central because of failed delivery attempts and/or refusal of delivery, you will receive a refund after the application of a restocking fee. In a special circumstance, subject to the sole discretion of Bourbon Central, an order may be re-shipped after a failed delivery with the addition of a forty ($40) dollar re-shipment fee. If the delivery fails a second time, the customer will be liable for the full cost of the order. 
• Damaged Items: While Bourbon Central takes every precaution to ensure your order is packaged properly and arrives safely, damage may still occur. Orders that include original packaging from the manufacturer or obtain non-conventional shaped bottles may be packed differently, but securely, in Bourbon Central’s sound business judgement. In the case of a breakage, customers will be required to e-mail an image of said breakage to be eligible for a deeper investigation and potential compensation. During times of extreme weather conditions, you are responsible for notifying Bourbon Central of any special requests to hold and postpone your order. 
• Special Requests: For certain items, namely Blade & Bow, Blanton's, and Booker's Bourbon, no specific key, batch or letter requests will be honored due to the high demand for the products. Further, any batch or release year shipped to the customer that differs from a product image on the website is the full liability of the end consumer. Unless specified on Bourbon Central's product page, no specificity is guaranteed.
• Gift Cards are eligible for one (1) year from the point of first being purchased. Thereafter, they will be deemed expired and ineligible for redemption at Bourbon Central.

• Limitation of Liability: Bourbon Central will not be liable under any legal theory, whether in tort (including negligence), contract, or otherwise for any incidental, consequential, indirect, special, or punitive damages arising out of your access to or use of the website, regardless of whether Bourbon Central has been advised of the possibility of such damages. Bourbon Central reserves the right to change any information contained on the website at any time at its sole and absolute discretion. If you do not agree with any of the terms and conditions of this website, or any content contained therein, do not use this website. Your sole and exclusive remedy against Bourbon Central is to discontinue use of this site and damages against Bourbon Central shall be limited to the dollar value of the order placed by you. 

• Disclaimer of Warranties: Every effort has been made to maintain the accuracy of this website. However, inadvertent factual or typographical errors may exist. Bourbon Central expressly disclaims all liability for any such errors or omissions in any of the information contained on this website. Accordingly, and without limiting the generality of the foregoing, the information contained herein is provided “as is” and without warranty of any kind whatsoever, either expressed or implied, including but not limited to, the implied warranties of merchantability or fitness for intended use. 

• Force Majeure: We will not be deemed to be in default of or to have breached any provision herein as a result of any delay, failure in performance or interruption of service, resulting from acts of God, acts of civil or military authorities, civil disturbances, war, strikes or other labor disputes, fires or other catastrophes which are beyond Bourbon Central’s reasonable control. 

• Legality & Validity: If any of these terms and conditions (or any portion thereof) of the application of any such provision (or any portion thereof) to any person or circumstance shall be held invalid, illegal, or unenforceable in any respect by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision hereof or the application of such provision to any other persons or circumstances, and the parties shall endeavor to fulfill the intent of the severed provision to the extent permitted by law.
